⚠️ Federal hemp restrictions
The hemp ban takes effect December 11, 2026.
Federal law is redefining what counts as hemp. On December 11, 2026, products above 0.4 mg of total THC per container — plus Delta-8, Delta-10 and HHC before that — fall outside the definition. Nothing is illegal today. Everything below is legal right now.
What is actually changing
Two sentences in a federal appropriations bill rewrite the 2018 Farm Bill definition of hemp.
Hemp used to be tested on delta-9 only. From December 11, 2026 it is the total THC figure — THCa included — that decides whether a plant or extract is hemp.
A hard ceiling on finished products. A single 10 mg gummy is 25× over it. Even full-spectrum oils with only trace THC can cross the line depending on how the FDA defines “container”.
Delta-8, Delta-10 and HHC are made by converting CBD in a lab. The one-year delay announced in September covers naturally occurring cannabinoids only, so these may lose hemp status a month earlier than everything else.
Nothing is final until the date arrives. Bills to loosen or further delay the rules are live. If the law moves, this page moves with it — the dates and the product list update themselves.
